Retribuzione intera per i corsi di aggiornamento Assodolab.

Da più parti docenti, soci e simpatizzanti dell’Assodolab
ci scrivono per chiedere chiarimenti circa la spettanza o meno della
retribuzione ai corsi organizzati dalla stessa Associazione e soprattutto se
hanno diritto o meno alla frequenza ai corsi di aggiornamento.
Cerchiamo di mettere un po’ d’ordine sulla questione.
L’Amministrazione di appartenenza, in questo caso il Ministero
dell’Istruzione, può effettuare dei corsi di formazione o di aggiornamento
rivolto ai docenti, ma come potete immaginare diventa troppo dispendioso e
complicato organizzare tali corsi a livello centrale. Considerato che in
ogni regione vi sono le Università, gli Uffici Scolastici Regionali nonché
gli Uffici provinciali periferici dello stesso Ministero, i corsi possono
essere organizzati da loro. E’ da considerare inoltre che anche in ambito di
singola Istituzione scolastica il docente può frequentare un simile corso
aggiornamento.
Ma quando il corso riguarda la disciplina di insegnamento o particolari
forme di aggiornamento, allora scendono in campo per la formazione dei
docenti le Associazioni Professionali Disciplinari.
Un chiaro esempio è l’Associazione Nazionale Docenti di Laboratorio,
in sigla ASSODOLAB, un Ente accreditato e
qualificato che offre formazione al personale della Scuola.
L’Associazione è riconosciuta dal Ministero dell’Istruzione in base al D.M.
177/2000 e alla Direttiva 90 del 1/12/2003.
UNO SGUARDO AL CONTRATTO COLLETTIVO NAZIONALE DEL LAVORO DELLA SCUOLA
Per la frequenza ai corsi di aggiornamento occorre tener presente un paio di
norme: la prima è quella dell’Art. 62 del C.C.N.L.
relativo all’anno 2002/2005 e più in particolare il comma 5 che recita: «Gli
insegnanti hanno diritto alla fruizione di cinque giorni nel corso
dell’anno scolastico per la partecipazione a iniziative di formazione
con l’esonero dal servizio e con sostituzione ai sensi della normativa sulle
supplenze brevi vigente nei diversi gradi scolastici. Con le medesime
modalità, e nel medesimo limite di 5 giorni, hanno diritto a partecipare ad
attività musicali ed artistiche, a titolo di formazione, gli insegnanti di
strumento musicale e di materie artistiche».
La seconda norma è dettata dall’Art. 3 del C.C.N.L.
del 26/05/1999. All’Articolo 3 si legge: « Il personale docente può
usufruire, con l’esonero dal servizio e con sostituzione ai sensi della
normativa vigente sulle supplenze brevi dei diversi gradi scolastici, di
cinque giorni nel corso dell’anno scolastico per la partecipazione a
iniziative di aggiornamento riconosciute dall’Amministrazione».
UNO SGUARDO ALLA RETRIBUZIONE DURANTE I CORSI DI FORMAZIONE E
AGGIORNAMENTO DEI DOCENTI
Al docente che partecipa ad uno o più corsi di aggiornamento spetta la
“retribuzione intera” purché non vengano superati i cinque giorni nel corso
di ogni Anno Scolastico.
UNO SGUARDO ALLA CONTRATTAZIONE DI ISTITUTO
Ad ogni inizio d’anno, in sede di Collegio dei Docenti, ogni Istituzione
scolastica approva la modalità di aggiornamento del personale docente. E’
bene quindi che ogni docente, si documenti su ciò che si è votato ad inizio
d’anno.
La possibilità di godere di un tale diritto (quello dell’aggiornamento del
docente) non deve compromettere eccessivi disservizi all’Istituzione
scolastica. Ad esempio, se in uno stesso periodo 20 docenti su un totale di
100, chiedono di partecipare ad un corso di aggiornamento, il dirigente
scolastico può concedere solo ad alcuni il diritto di allontanarsi
dall’Istituto mentre ad altri può negare il permesso.
E’ bene quindi che l’insegnante che desideri partecipare ai corsi
organizzati dall’Assodolab, si affretti a chiedere al Dirigente Scolastico,
in forma scritta, la richiesta di partecipazione al corso di aggiornamento.
Tale richiesta deve essere protocollata in segreteria docenti.
E’ bene chiedere in segreteria se la «quota di iscrizione ai corsi di
aggiornamento» e «le spese di trasporto per seguire i corsi di
aggiornamento» organizzati al di fuori dall’Istituto dove si presta servizio
potranno essere recuperati dal docente oppure no.
Ogni scuola, ogni Istituzione scolastica, ogni Collegio dei docenti ad ogni
inizio anno vota anche per queste cose.
In fondo, la formazione è un diritto di ogni docente ed è strutturata in
maniera diversa a secondo dell’Istituto dove si presta servizio.
Il compito del docente è tenersi informato di ciò che accade intorno.
